NCLT & Insolvency

Insolvency and restructuring matters require a combination of legal strategy, commercial understanding and a clear appreciation of stakeholder interests. Our NCLT & Insolvency practice advises companies, financial institutions, operational creditors, investors, resolution applicants, promoters and other stakeholders on matters arising under the Insolvency and Bankruptcy Code, 2016.

Overview

We represent clients before the National Company Law Tribunal (NCLT), National Company Law Appellate Tribunal (NCLAT) and other relevant forums in relation to insolvency proceedings, corporate restructuring, creditor representation, distressed asset transactions and challenges arising during the insolvency process.

Our team advises clients from the early stages of financial distress through resolution, including assessment of insolvency options, preparation and filing of claims, representation before committees of creditors, evaluation of resolution plans, acquisition of distressed assets and implementation of approved resolutions.

Experience

Our lawyers have advised corporates, financial institutions, investors, resolution applicants and other stakeholders on insolvency and restructuring matters involving stressed businesses, distressed assets and creditor rights.

We assist clients in navigating complex issues relating to admission proceedings, classification of claims, voting rights, security interests, resolution plans, asset acquisitions and distributions under the insolvency framework.

We also advise investors and strategic acquirers on opportunities involving distressed assets, including legal due diligence, structuring of bids, acquisition through insolvency processes and post-resolution implementation.

By combining insolvency expertise with our experience in corporate, finance and restructuring matters, we provide commercially focused advice aimed at protecting stakeholder interests and achieving effective resolution outcomes.
